Terms of Use — Commutopia
Last updated: 2 November 2026
1. Provider, contact and scope
Commutopia is provided by SAMSUFI SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Jagiellońska 4A, 19-120 Knyszyn, Poland; KRS 0000901262; EU VAT PL5423435334. General questions, support and complaints: [email protected]. Privacy matters: [email protected]. We do not provide a telephone contact number.
These terms govern use of the free Commutopia mobile game and related information and downloadable materials on commutopia.online. The Android package is be.kapica.commutopia. The game is a single-player city-building simulation featuring road traffic and public transport. Cities, gameplay and progress are available offline.
These terms are available before you download the game, on commutopia.online and in the store listing, and in the game under Settings → About → Terms of use. The agreement for the free game is concluded when you download or install the game and start using it. If you cannot access or understand these terms, you can contact the provider before using the game.
2. Free use and licence
The game is free. There are no advertisements, in-app purchases or paid subscriptions. You are not required to create an account or consent to optional crash reports to play.
The publisher grants you a free, non-exclusive, non-transferable licence to install and use the game on your own compatible devices for personal gameplay, for as long as the game is lawfully made available to you, subject to mandatory law and any applicable third-party open-source licences. This is a right to use the game, not a transfer of ownership of its code, graphics, trademarks or other protected material. Intellectual property rights in Commutopia belong to the publisher, subject to any third-party rights and licences.
You may use the built-in export and sharing functions as described below. You must not distribute the game itself as your own product, sell unauthorised copies or misrepresent ownership of its protected assets. This provision does not restrict uses permitted by mandatory law or separately applicable open-source licences.
3. Gameplay and acceptable use
Commutopia is a single-player game. It does not have a developer-operated player account, multiplayer service or in-game chat. The Android release works offline, except for optional diagnostics that require your consent. An Android system backup, if enabled in your Google account settings, is managed by Android/Google, not by a game cloud-save account provided by us.
Use the game lawfully and respect the rights of other people. If you export, name, publish or send a city, picture or challenge, you are responsible for the user-entered names and other content you choose to disclose. Do not include other people's personal information, unlawful material or content that infringes their rights.
3.1 City exports
The game's share function lets you send a .commutopia file containing the full city save and its name. It may include JSON data, gzip compression and a CRC32 checksum but does not encrypt the data. Anyone receiving the file may be able to inspect it. Choose recipients carefully.
3.2 Photos and custom challenges
Photo mode generates JPEG images of the game scene, with date/time in the filename and without EXIF/GPS metadata. Custom challenges can be shared as text codes using the system share sheet. A challenge code is text starting with CT1. that contains the challenge name, description and optional hint you typed, plus map and rules data (road network, transit lines, trips and goals). It contains no author, account or device identifiers and is shared only when you copy or send it. Do not put personal data in the challenge name or description. The game does not automatically publish your exports, pictures or codes to the publisher.
You remain responsible for what you independently share outside the game and for the terms of any receiving application or service.
4. Devices, updates and data
The Android version 1.0.0 supports devices running at least Android 7.0 (API 24), subject to device capabilities. The game uses Capacitor, WebView and WebGL. Device graphics performance and operating-system behaviour can affect the experience. The game may receive bug fixes, compatibility updates and functional changes.
Progress and cities are stored locally on the device. Clearing app data or uninstalling removes local game data, but may not remove separate Android/Google backups or crash reports already sent with your consent. You can use the game's export feature to keep a copy of a city you wish to retain; such exports are not encrypted.
How personal data is handled, including the voluntary 16+ crash-reporting choice, is explained in the Privacy Policy. You may refuse or withdraw optional diagnostic consent without losing access to the core game.
5. Digital content conformity, support and complaints
We aim to supply a game that matches its description and applicable digital-content conformity requirements. If the game does not function as described, write to [email protected] and describe the problem, the game version and, if relevant and known, the device or operating-system version. You do not have to send optional Crashlytics reports to file a complaint.
The game is provided free of charge, and you do not provide personal data in exchange for it: optional crash reports are based on separate consent and are not a condition of use. To the extent that mandatory consumer law applies to the game, including the rules implementing Directive (EU) 2019/770 (in Poland, Chapter 5b of the Consumer Rights Act), consumers have the statutory rights that apply when digital content is not supplied or does not conform to the contract, in particular the right to have it brought into conformity, and other remedies where the statutory conditions are met. You can report a lack of conformity to [email protected]. Nothing in these terms removes rights that applicable consumer law grants you.
We handle complaints by email and respond within the periods required by applicable law. There is no purchase price to refund. This does not limit any statutory remedy that may apply even when the game is free.
Any statutory right to withdraw from a distance contract, and any exceptions to that right for the supply of digital content, apply only under the conditions set out in the relevant law. Downloading the game does not, by itself, constitute a blanket waiver of mandatory withdrawal rights.
6. Changes, availability and withdrawal of the game
The publisher may correct defects, update the game, modify features and stop distributing it in the future. The game being available offline does not guarantee that every version will work indefinitely on every device or operating-system update. Ending distribution does not automatically delete the copy installed on your device.
If changes to digital content or these terms require advance information, a specific legal basis, additional consent or other consumer safeguards, those requirements continue to apply. We will make the current text available on the website and update store information when appropriate. Material changes will not retrospectively remove rights that have already arisen.
You may stop using the game and uninstall it at any time. You can also delete local game data. For personal-data deletion requests, contact [email protected] without installing the app.
7. Liability and mandatory rights
To the extent permitted by law, the publisher is not responsible for loss caused solely by your voluntary disclosure of unencrypted exports to an unsuitable recipient or by services you independently select to receive such files. This does not exclude responsibility for the publisher's own unlawful acts or omissions.
Nothing in these terms excludes or restricts statutory consumer conformity rights, responsibility for wilful misconduct, or any liability that cannot legally be excluded or limited. No general “as is” disclaimer overrides mandatory protections.
8. Governing law and consumer dispute resolution
Polish law governs these terms, without depriving a consumer habitually resident in another country of mandatory protections provided by the law of that country, including under applicable EU rules. Mandatory rules on the court competent for a consumer dispute are unaffected.
Contact [email protected] first if a problem arises. SAMSUFI does not take part in out-of-court consumer dispute resolution (ADR) procedures and is not obliged to use them. Consumers may obtain free assistance from consumer ombudsmen (in Poland, the municipal or district consumer ombudsman, miejski or powiatowy rzecznik konsumentów) and may bring their claims before the competent court. The former European Commission ODR platform was discontinued on 20 July 2025.
9. Planned App Store edition
An iOS version is planned after Android 1.0. For the iOS version distributed through the Apple App Store, Apple's standard Licensed Application End User License Agreement will apply, supplemented by these terms insofar as they are compatible with that licence and with mandatory local law. These provisions do not mean that an iOS version is already available.
10. Final provisions
If a provision of these terms is unenforceable under applicable mandatory law, the remaining provisions continue to apply where legally possible. The English and Polish versions are intended to convey the same rules; no language version displaces mandatory protections applicable to the user.
